Understanding Lasting Power of Attorney (LPA)
What is a Lasting Power of Attorney (LPA)?
An LPA is a legal document that allows you to appoint someone you trust (an attorney) to make decisions on your behalf if you’re no longer able to, for example due to dementia or an accident. There are two types of LPAs: Health & Welfareand Property & Financial Affairs.
What’s the difference between an LPA and a Will?
An LPA applies while you are alive, giving trusted people (attorneys) authority to act on your behalf. A Will only takes effect after death, directing how your estate is managed.

Health & Welfare LPA
Covers decisions about medical care, life-sustaining treatment, and where you live.
Property & Financial Affairs LPA
Covers decisions about finances, property, bank accounts, and dealing with financial organisations.

Anyone over 18 should consider registering an LPA—illness or accidents can happen at any time.

The LPA Process
How do I get an LPA?
Each LPA must be registered with the Office of the Public Guardian (OPG). You apply separately for Health & Welfare and Property & Financial Affairs. Libra LPA supports you through the whole process.
How long does it take to get an LPA?
With our full support service, applications are usually submitted within 8 weeks. The Office of the Public Guardian then takes around 20 weeks to register them.
What does it cost?
Depending on the service you choose with Libra LPA, it costs from £49.00 plus registration fees with the Office of the Public Guardian of £82 per LPA. You may qualify for remission or exemption of these fees if on low income or benefits.
Choosing and Managing Attorneys
How many attorneys can I choose?
You can have multiple attorneys. Two attonryes plus two replacements is recommended.
Who can be an attorney?
Anyone you trust: family, friends, even those living abroad. They must know you well and you must trust them to act in your best interests.
How do attorneys act?
You decide if attorneys act together (jointly) on all decisions or independently (severally) for some or all decisions. Your LPA advisor can help you work out whats best for you.
Legal Safeguards & Control
Will I lose control of my finances?
No. Your attorney only acts if authorised. They must follow the Mental Capacity Act and are monitored by the Court of Protection and the Office of the Public Guardian.
How long does an LPA last?
It remains valid during your lifetime but ends at death, unless cancelled.
Can an LPA be challenged?
Yes, if concerns arise about donor capacity or an attorney’s actions.
Can I make changes or cancel an LPA?
Yes, you can make changes to your (LPA) even after it has been registered. For example, to remove an attorney via a written statement called a ‘partial deed of revocation’. If you want to add another attorney, you will need to end your LPA and make a new one.
People Involved in the Process
What is the role of a witness?
A witness observes signatures but doesn’t read the LPA. They must be over 18 and not the donor. Attorneys can witness each other’s signatures but not the donor’s.
What is the role of a certificate provider?
They confirm the donor understands the LPA and is acting freely with capacity. Libra LPA can help arrange one if needed.
What if capacity is in question?
If you are unsure of the mental capacity of a donor or attorneys, then a Mental Capacity Assessment can take place before the LPA process. This must be done by a trained professional such as a social worker or doctor. Libra LPA can arrange this service.

What if I struggle to sign documents?
Someone can sign on your behalf under guidance. Libra will advise and support you.
